Terms and Conditions

I. PRICES

All prices listed in the Travis Pattern Sprinkler Irrigation Products catalog and Wade Rain Sprinkler Irrigation Products catalog are recommended list prices, FOB Spokane, Washington and are shown in US Dollars. Prices are subject to change without notice and shall be those in effect at time of shipment. All quotations are valid for 30 days unless otherwise indicated.

II. DOMESTIC PAYMENT TERMS

Payment terms are Net 30 days - unless otherwise noted. Interest will be charged at the legal rate on all amounts which are past due, beginning on the 31st day following the date of the invoice and every day thereafter until paid, except in the case of Special Terms when interest charges will begin on the 1st day after payment becomes due and every day thereafter.

III. GOODS DAMAGED OR LOST IN TRANSIT

Goods damaged or lost after delivery are the responsibility of the buyer. Delivery of the goods to the purchaser takes place when the goods are accepted by the carrier; and claims for loss or damage must be made to the carrier. In no case shall Travis Pattern & Foundry be responsible for any consequential damage.

IV. SHORTAGES

All claims for shortages must be made within 7 days of receipt of shipment. Any shortage claim must be identified by the Packing Slip Number or Invoice Number and a copy of the Delivery Receipt.

V. RETURN MERCHANDISE

The return of current catalog merchandise in new condition is subject to a 20% restocking charge and must be pre-approved by the factory. When approved, returns will be accepted if accompanied by a Returned Goods Authorization (RGA) upon receipt. No custom fabricated items will be accepted for return. All merchandise must be returned Freight Prepaid unless otherwise specified. No returns accepted over 1 year after purchase date.

VI. CANCELLATION OF MERCHANDISE

Cancellation of standard items may be honored only if the request is made prior to shipment. Custom made or special items may not be canceled unless cancellation precedes the start of manufacture or purchase of the item.

VII. DELAY OF DELIVERY

Travis Pattern & Foundry shall not be liable for failure to deliver or delays in delivery which is occasioned by the causes beyond the control of Travis Pattern & Foundry. These causes may include, but are not limited to, strikes, lockouts, fires, embargoes, war or other hostilities, acts of God, inability to obtain shipping space, machinery breakdowns, delays of carriers or suppliers, and domestic or foreign government regulations.

VIII. MINIMUM ORDER

All orders must be a minimum of $50.00. All invoices under the $50.00 minimum are subject to a surcharge.

IX. HANDLING FEE

For a less than pallet order that ship via collect or third party accounts, a handling feel will be added to the invoice.

X. PRODUCT IMPROVEMENT

Travis Pattern & Foundry, whose policy is one of continuing product improvement, reserves the right to make changes in design and changes or improvements upon its products without assuming any obligation to change products therefore manufactured, or used, if manufactured by others, in the same manner. Product model changes or designs are subject to change without notice.

LIMITED WARRANTY

I. Travis Pattern & Foundry manufactures various brand name couplers, valves and certain mechanical equipment. Any part manufactured by Travis which is proven defective as to material or workmanship within one year from the date of sale by Travis will be replaced free of charge F.O.B. Spokane, Washington, upon return of such defective part to Travis, transportation prepaid. No parts, however, shall be returned without the express written authority of Travis. TRAVIS MAKES NO WARRANTY EXPRESS OR IMPLIED, EXCEPT SUCH WARRANTIES AS ARE DEFINITELY SET FORTH HEREIN. This Warranty is void if the equipment is used on lines with pressures in excess of those recommended by Travis or if used in a manner not in conformity with Travis's published instructions.

II. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. TRAVIS PATTERN & FOUNDRY MAKES NO WARRANTY OF MERCHANTABILITY OR IMPLIED WARRANTY OF FITNESS AS TO ITS PRODUCTS

III. Under no circumstances shall Travis be held for any consequential or other damages, losses or expenses which may arise from installation or use of the equipment regardless of advice or recommendations that may have been made by any agent or employee of Travis Pattern & Foundry or its distributors/dealers.

IV. THE DISTRIBUTOR AND/OR DEALER IS NOT AUTHORIZED TO MAKE ANY WARRANTY OF PERFORMANCE OR EFFICIENCY OR OTHER OPERATING GUARANTEE ON ANY TRAVIS PATTERN SYSTEM OR ANY OF ITS COMPONENT PARTS NOT SET FORTH HEREIN

MATERIAL SHIPPING UNDERSTANDING

Travis Pattern & Foundry shall not be responsible for any delay in shipping resulting from destruction of offices, warehouses, factories, or other facilities, strikes, lockouts, shortage of merchandise at the factory or plant of Travis Pattern & Foundry, delays in obtaining merchandise from a factory or plant or other sources of supply, act of God, or other causes.

RESERVATIONS AND RIGHTS FOR IMPROVEMENTS

Travis Pattern & Foundry reserves the right to make changes in design and changes or improvements upon its products without assuming any obligation to change products theretofore manufactured in the same manner.

PARTS MANUFACTURED BY OTHERS

Parts of Travis Pattern Systems manufactured by others than Travis Pattern & Foundry (all buy-out items and such items as gear reducers, tires, aluminum tubing, electric motors, gas engines, sprinklers, etc.) may carry manufacturer's guarantee and are not guaranteed by Travis Pattern & Foundry.

APPLICATION CONDITIONS

This warranty shall apply to all Travis Pattern Systems, subject to the following limitations:

a) Water supplied to the system shall be clean and noncorrosive, free of sand or other foreign matter which adversely affects the operation of the system or may unduly shorten the life of the system or any of its parts.

b) Water pressure applied to the system shall be limited to a maximum of 100 P.S.I. operating pressure unless otherwise indicated in writing by Travis Pattern & Foundry.

c) All systems are to be used with water only.

d) The system must be operated in conformance with the manufacturer’s instructions and all safety instructions must be followed.
